Terms & Conditions – Communicate Digital

1. General

– These Terms & Conditions (“Terms”) apply to all products and services offered by Communicate Digital, including but not limited to website development, IDX real estate websites, CRM setups, e-commerce websites, mobile apps, subscriptions, and one-time services (“Services”).
– By purchasing any Service from our website, you agree to be bound by these Terms.
– This agreement is governed by the laws of Punjab, India.

2. Service-Specific Details (Product Page Prevails)

Each Service (product) may have its own:
– Name and description
– Pricing (one-time, monthly, yearly, or mixed)
– Delivery timelines (e.g., 7 working days, 15 working days, etc.)
– Inclusions (e.g., hosting, SSL, domain, app, maintenance)
– In case of any conflict between these general Terms and the specific details shown on a product page, the product page details will prevail for that specific Service.

3. Subscriptions and One-Time Services

We may offer:
– Monthly subscription plans
– Yearly subscription plans
– One-time Service fees

For subscriptions:
– Billing will recur automatically at the chosen interval (monthly or yearly) until cancelled by you.
– You authorize us and/or our payment provider to charge your chosen payment method on a recurring basis.

For one-time Services:
– Payment is charged in full at the time of purchase.

4. Delivery Timelines

– Standard or estimated delivery timelines (e.g., “7 working days”) will be mentioned on the relevant product page.
– Delivery timelines start only after you have provided all required content, access, approvals, and information requested by our team (such as logos, branding, text, images, MLS/IDX access, product data, etc.).
– Delays caused by you (late content, incomplete information, access issues, lack of approvals, etc.) will extend delivery and will not be considered a delay from our side.

5. No Refund Policy (General Rule)

– All payments made for our Services (subscriptions and one-time Services) are strictly non-refundable.
– By completing a purchase, you acknowledge and accept that no refunds will be provided, except in the limited exceptions described in Section 6.

6. Refund Exceptions (Limited Cases Only)

A full refund may be offered ONLY in the following situations:

– 6.1 Significant Delay Solely From Our Side
– If we fail to deliver the core Service for a specific product within:
– The delivery timeline shown on the product page, AND
– An additional grace period of 7 working days beyond that timeline
– AND the delay is solely due to our actions or omissions (not due to your delay, missing information, access issues, or scope changes),
– Then you may request a full refund for that specific order.

– 6.2 Double Booking / Duplicate Payment
– If you accidentally make a duplicate purchase of the same plan for the same project and can provide proof of the duplicate charge, we may issue a full refund for the duplicate transaction.

– In all other cases, including but not limited to:
– Change of mind
– Business closure
– Budget issues
– Lack of time to proceed
– Dissatisfaction with design preferences after agreed scope
no refund will be issued.

7. Cancellations (Subscriptions)

– You may cancel a subscription at any time to stop future renewals.
– Cancellation will prevent the next billing cycle, but:
– No refunds will be issued for the current billing period already paid.
– Upon cancellation and/or non-renewal:
– Hosting, SSL, domain, maintenance, and other ongoing services provided under that plan may be suspended or terminated at the end of the paid period, as per the product-specific terms.

8. Client Responsibilities
You are responsible for:
– Providing accurate and complete content, information, and access needed to deliver the Service.
– Ensuring you have rights and permissions for all content you provide (text, images, logos, videos, property data, etc.).

We are not liable for delays or issues caused by:
– Late or incomplete content
– Incorrect or invalid access credentials
– Scope changes mid-project
– Third-party platform issues (e.g., hosting providers, MLS/IDX providers, payment gateways).

9. Changes to Services, Pricing, and Terms

We may update:
– Service features
– Pricing
– These Terms
at any time.
– Any changes will apply to future purchases and renewal periods, not to the current active billing period already paid.

10. Limitation of Liability

To the maximum extent permitted by law, we are not responsible for:
– Indirect, incidental, or consequential losses
– Loss of profits, revenue, data, or business opportunities
arising from the use or inability to use our Services.
– Our total liability for any claim related to a Service will be limited to the amount you paid for the most recent billing period or the specific one-time Service associated with that claim.
